How long does it take to get divorced in Virginia?

The answer to this question depends the circumstance. If you and your spouse have no children and have a signed agreement resolving all of your issues you can file a no fault divorce after you have been separated for six months. If you and your spouse have children or do not have a separation agreement you can file a no fault divorce after you have been separated for one year. If your case involves a fault ground such as adultery, cruelty, or desertion you can file for divorce right away but in the case of cruelty or desertion you will have to wait for the one year separation period to elapse before you can finalize the divorce.
